By using this website, placing an order, booking a ticket or performance, registering for a course or workshop, downloading music, or subscribing to our newsletter, you agree to these Terms & Conditions.

These Terms should be read together with our:

Any event, course, workshop or booking-specific terms shown at checkout or on the relevant page

Nothing in these Terms affects your statutory rights under Irish or EU consumer law.

1. About This Website

This website is used to promote and sell music, events, performances, courses and related services provided by [Artist / Business Name], an Ireland-based singer, musician and songwriter.

Through this website, you may be able to:

  • Purchase physical CDs.
  • Purchase and download music in MP3 format.
  • Book concert tickets.
  • Enquire about or book live performances.
  • Register for online or in-person courses and workshops.
  • Subscribe to our newsletter.
  • Contact us about music, events, courses, workshops or related services.

2. Eligibility to Use This Website

You must be at least 18 years old to make purchases, bookings or paid registrations through this website.

If you are under 18, you may only use this website and make purchases with the involvement and permission of a parent or guardian.

By placing an order or booking, you confirm that the information you provide is accurate, complete and current.

3. Products and Services

We make reasonable efforts to describe all products, downloads, tickets, performances, courses and workshops accurately.

However, images, audio samples, descriptions, event details, course outlines, availability and prices may occasionally contain errors or need to be updated.

We reserve the right to correct errors, update information, change availability, withdraw products or services, or cancel orders where necessary.

4. Pricing and Payment

All prices are shown in euro (€) unless otherwise stated.

Prices may include or exclude VAT depending on the tax status of Maria Butterly. Where VAT applies, this will be handled in accordance with Irish tax requirements and shown where required.

Payment must be made using the payment methods available at checkout. Orders, bookings and registrations are not confirmed until payment has been successfully received, unless we agree otherwise in writing.

We may use third-party payment processors such as Stripe, PayPal, WooPayments or other providers. Your payment details are handled by the relevant payment processor and are subject to that provider’s own terms and privacy policy.

5. Physical CDs

Physical CDs are sold subject to availability.

Once your order is accepted, we will arrange delivery to the address provided at checkout.

You are responsible for ensuring that your delivery address is correct. We are not responsible for failed or delayed delivery caused by incorrect or incomplete address details supplied by you.

Estimated delivery times are not guaranteed unless expressly stated.

Your rights to cancel, return or request a refund for physical CDs are set out in our Refund and Returns Policy. Consumers buying online in Ireland generally have a 14-day cooling-off period for many online purchases, although there are exceptions, including sealed CDs once opened.

6. Downloadable MP3 Music

MP3 music files sold through this website are digital content.

When purchasing MP3 downloads, you may be asked to consent to immediate access to the digital content and to acknowledge that you lose your right to cancel once the download or digital supply begins.

You may not copy, share, upload, distribute, resell, license, broadcast, commercially exploit or otherwise make the MP3 files available to others unless we give you written permission.

Your purchase gives you a personal, non-exclusive, non-transferable licence to download and listen to the music for personal use only.

If a digital file is faulty, inaccessible, corrupted or not as described, please contact us. Irish consumer law requires digital content and digital services to conform to the contract, and where they do not, the trader must resolve issues at no cost, within a reasonable time and without significant inconvenience.

7. Concert Tickets

Concert tickets may be sold directly through this website or through a third-party ticketing provider.

Tickets are usually issued for a specific date, time, venue and performance. Please check all event details carefully before booking.

Unless otherwise stated:

  • Tickets are non-refundable for change of mind.
  • Tickets may not be resold commercially.
  • Entry may be subject to venue rules, age restrictions, accessibility rules, safety policies and local regulations.
  • Late admission may not be possible.
  • The venue or organiser may refuse admission where reasonably necessary, including for safety, security or inappropriate conduct.

The normal 14-day cooling-off period does not generally apply to tickets for dated leisure events such as concerts, performances and similar events. This is reflected in Irish consumer guidance on online purchases and event tickets.

If an event is cancelled or rescheduled, your rights and options will be explained in accordance with applicable law and our Refund and Returns Policy.

8. Performance Bookings

Performance bookings may include live music appearances, private events, session work, commissioned performances, corporate events, weddings, festivals or other engagements.

A performance booking is not confirmed until we have accepted the booking in writing and any required deposit or payment has been received.

Performance bookings may be subject to a separate written agreement covering:

  • Date, time and location.
  • Performance duration.
  • Fee and deposit.
  • Travel, accommodation and expenses.
  • Technical requirements.
  • Cancellation terms.
  • Weather or outdoor performance arrangements.
  • Sound, equipment, access and safety requirements.
  • Recording, filming and publicity permissions.

Where there is a conflict between these Terms and a signed performance agreement, the signed performance agreement will take priority for that booking.

We reserve the right to refuse or cancel a performance booking where the event is unsafe, unlawful, discriminatory, abusive, reputationally harmful, technically unsuitable, or otherwise inappropriate.

9. Courses and Workshops

Courses and workshops may be offered online, in person, live, pre-recorded, one-to-one, group-based or as a combination of formats.

By registering for a course or workshop, you agree to:

  • Attend at the scheduled time where applicable.
  • Behave respectfully towards the tutor, artist, staff and other participants.
  • Follow any health, safety, venue or online participation rules.
  • Not record, copy or share course content unless expressly permitted.
  • Not distribute course materials to non-participants.

We may change a course or workshop tutor, venue, schedule, format or content where reasonably necessary. If a material change affects your booking, we will explain your options.

Course and workshop materials are provided for your personal learning use only. They may not be copied, resold, uploaded, distributed, taught from, or used commercially without written permission.

Irish consumer law distinguishes between goods, digital content, digital services and services, with different remedies depending on what has been purchased.

10. Online Course Access and Digital Materials

Where a course or workshop includes digital materials, recordings, downloads, online access links, PDFs, videos or audio files, these are provided for your personal use only.

You must not:

  • Share login details.
  • Share private course links.
  • Download or copy materials except where expressly allowed.
  • Upload materials to public websites, social media, file-sharing platforms or AI training tools.
  • Reproduce, teach, adapt or commercially exploit the materials.

Access periods, if any, will be stated on the relevant course page or booking confirmation.

We are not responsible for your inability to access online courses due to your own internet connection, device, software, email filtering, browser settings or failure to follow access instructions.

11. Newsletter Subscription

You may subscribe to our newsletter by providing your email address through the website.

Newsletter emails may include updates about music releases, concerts, performances, courses, workshops, offers, news and related content from Maria Butterly.

By subscribing, you agree that we may use your email address to send you newsletter and marketing communications.

You can unsubscribe at any time by clicking the unsubscribe link in our emails or by contacting us at info@mariabutterly.com.

In Ireland, electronic direct marketing generally requires clear, affirmative consent, such as an opt-in, unless a limited customer relationship exception applies and specific conditions are met. The Data Protection Commission also highlights the need for transparency and accessible unsubscribe options.

For more information about how we collect, use and protect personal data, please see our Privacy Policy.

12. Accounts and Customer Information

If this website allows you to create an account, you are responsible for keeping your login details secure.

You must not share your account with anyone else or use another person’s account without permission.

We may suspend or close an account where we reasonably believe that:

  • The account is being misused.
  • False or misleading information has been provided.
  • The account is being used to breach these Terms.
  • The account poses a security, fraud, payment or legal risk.

13. User Conduct

You agree not to use this website to:

  • Break any law or regulation.
  • Infringe intellectual property rights.
  • Harass, abuse, threaten or defame any person.
  • Upload or transmit malware, spam or harmful code.
  • Attempt to access restricted areas of the website.
  • Interfere with website security, performance or availability.
  • Scrape, copy or extract website content without permission.
  • Make fraudulent purchases, bookings or payment claims.

We may restrict access to the website or cancel orders where we reasonably believe these Terms have been breached.

14. Intellectual Property

All music, lyrics, recordings, compositions, arrangements, performances, videos, images, photographs, designs, logos, written content, course materials, downloads and other content on this website are owned by or licensed to Maria Butterly, unless otherwise stated.

All rights are reserved.

You may view the website and download purchased items only for the personal use permitted by these Terms.

You must not copy, reproduce, modify, publish, perform, broadcast, distribute, sell, license, sample, remix, adapt, upload, scrape or commercially exploit any website content, music, lyrics, recordings, downloads or course materials without prior written permission.

Purchasing a CD, MP3, ticket, course, workshop or booking does not transfer copyright or other intellectual property rights to you.

15. Reviews, Comments and Submitted Content

If you submit reviews, testimonials, comments, messages, photos or other content to us or through the website, you confirm that:

  • The content is accurate and lawful.
  • You have the right to submit it.
  • It does not infringe anyone else’s rights.
  • It is not abusive, defamatory, obscene, discriminatory or misleading.

You grant us permission to use submitted reviews or testimonials for promotional purposes, unless you tell us otherwise in writing.

We reserve the right to remove or refuse to publish user-submitted content.

16. Third-Party Links and Services

This website may link to third-party websites, platforms or services, including ticketing platforms, payment processors, video platforms, streaming services, social media platforms, venue websites or mailing list providers.

We are not responsible for the content, availability, terms, privacy practices or actions of third-party websites or services.

You should read the terms and privacy policies of any third-party platform you use.

17. Availability of the Website

We aim to keep the website available and working properly, but we do not guarantee uninterrupted access.

We may suspend, withdraw, update or restrict access to the website for maintenance, security, business or legal reasons.

We are not liable for website downtime, technical issues, temporary unavailability or loss of access, except where liability cannot be excluded by law.

18. Cancellations, Refunds and Returns

Cancellations, refunds and returns are handled in accordance with our Refund and Returns Policy.

Different rules may apply depending on whether you have purchased:

  • A physical CD.
  • A digital MP3 download.
  • A concert ticket.
  • A performance booking.
  • An online course.
  • An in-person workshop.
  • A service that has already begun with your consent.

Please read the Refund and Returns Policy carefully before purchasing or booking.

19. Consumer Rights

Nothing in these Terms limits or excludes your statutory rights.

If you are a consumer in Ireland or the EU, you may have rights under Irish and EU consumer law relating to goods, digital content, digital services, services, online purchases, cancellation rights and remedies for faulty or non-conforming products or services.

A distance contract includes online purchases, and online consumers have protections under consumer law.

20. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Indirect or consequential loss.
  • Loss of profit, revenue, opportunity or business.
  • Loss caused by incorrect information you provide.
  • Loss caused by third-party platforms, venues, payment processors, email providers or ticketing providers.
  • Technical issues outside our reasonable control.
  • Your failure to attend an event, course or workshop.
  • Your failure to access downloads, emails or course links due to your own device, email account or internet issue.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.

21. Force Majeure

We are not responsible for delay or failure to perform our obligations where this is caused by events outside our reasonable control.

This may include illness, injury, bereavement, extreme weather, venue closure, transport disruption, strikes, power failure, internet failure, pandemic restrictions, government action, fire, flood, security incidents, technical failures or other events beyond our control.

Where such an event affects a booking, course, workshop, performance or concert, we will try to offer a reasonable solution, such as rescheduling, replacement access, credit or refund where appropriate and legally required.

22. Changes to These Terms

We may update these Terms from time to time.

The version published on this website at the time of your purchase, booking, registration or subscription will apply to that transaction unless a legal change requires otherwise.

Please check this page regularly for updates.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland.

If you are a consumer, you may also have rights under the mandatory consumer protection laws of the country where you live.

Any dispute will be subject to the courts of Ireland, unless applicable consumer law gives you the right to bring proceedings elsewhere.
