This Refund and Returns Policy applies to purchases made through mariabutterly.com, including physical CDs, downloadable MP3 music files, concert tickets, performance bookings, and online or in-person courses and workshops.

We are based in Ireland and aim to handle all refunds, returns and cancellations fairly, in line with Irish and EU consumer law. Consumers buying online in Ireland generally have a 14-day cooling-off period for many online purchases, but some products and services are treated differently, including sealed CDs once opened, digital downloads started with the customer’s consent, and dated event tickets.

2. Physical CDs

Change-of-mind returns

You may cancel your order for a physical CD within 14 days of receiving it, provided you tell us within that period. After notifying us, you have a further 14 days to return the item.

To be eligible for a change-of-mind return:

  • The CD must be returned in its original condition.
  • If the CD was supplied sealed, it must remain sealed and unopened.
  • You must include your order number or proof of purchase.

For hygiene, copyright and anti-copying reasons, sealed CDs cannot be returned once the seal has been broken, unless the CD is faulty or not as described. Irish consumer guidance recognises opened CDs, DVDs and computer software as an exception to the normal cooling-off return right.

Faulty or incorrect CDs

If your CD is faulty, damaged on arrival, or not the item you ordered, please contact us as soon as possible with your order number and, where helpful, photos of the issue.

Where the item is faulty or not as described, we will offer an appropriate remedy, which may include replacement, repair, refund or another remedy required by law.

Return postage

For change-of-mind returns, you are responsible for return postage unless we agree otherwise. We recommend using a tracked service, as we cannot refund items we do not receive.

If the item is faulty, damaged or incorrect, we will reimburse reasonable return postage costs where a return is required.

3. Downloadable MP3 Music Files

MP3 downloads are digital content.

When you purchase a downloadable MP3, you may be asked to agree that the download will be made available immediately and to acknowledge that you lose your right to cancel once the download or digital supply begins.

Once the MP3 file has been supplied or downloaded with your consent, we do not offer change-of-mind refunds, unless required by law.

If a download is faulty, inaccessible, corrupted, not as described, or you receive the wrong file, please contact us. Under Irish consumer law, digital content must meet the contract description and work as expected; where there is a problem, the trader must resolve it at no cost, within a reasonable time and without significant inconvenience.

Depending on the issue, we may provide:

  • A replacement download link.
  • Technical help.
  • A corrected file.
  • A refund or price reduction where required by law.

Download links are for your personal use only and must not be shared, resold, uploaded or redistributed.

4. Concert Tickets

Concert tickets are usually for a specific date, venue and performance. Once purchased, tickets are non-refundable for change of mind, unless otherwise stated at the time of purchase.

The normal 14-day online cooling-off period does not generally apply to tickets for concerts, festivals, sporting events and similar dated leisure events.

Cancelled or rescheduled concerts

If a concert is cancelled by us, the venue or the event organiser, you will be offered a refund or another remedy where required by law.

If a concert is rescheduled, your ticket will usually remain valid for the new date. If you cannot attend the new date, please contact us and we will explain the available options.

Lost tickets

If tickets are issued electronically, we may be able to resend your confirmation or ticket link to the email address used at checkout. We may ask for proof of purchase before doing so.

5. Performance Bookings

Performance bookings include private events, commissioned performances, appearances, session work, live music bookings and similar services.

The refund and cancellation terms for performance bookings depend on the booking agreement, date, preparation work already carried out, travel arrangements, deposits and any expenses already incurred.

Unless otherwise agreed in writing:

  • Deposits may be non-refundable once the date has been reserved.
  • Cancellations close to the performance date may be charged in full or in part.
  • Any non-refundable expenses already incurred, such as travel, accommodation, rehearsal costs or third-party musician costs, may be deducted from any refund.
  • If we must cancel due to illness, emergency or circumstances beyond our control, we will offer a refund of amounts paid for the cancelled performance, or attempt to reschedule where practical.

Where a performance booking is made online by a consumer, cancellation rights may apply in some circumstances, but these rights may be affected once performance of the service has begun with your agreement or where the booking relates to a specific date or period.

Full booking-specific terms should be confirmed in writing at the time of booking.

6. Online Courses and Workshops

Online courses and workshops may include live online classes, webinars, video sessions, downloadable course materials, recorded lessons or a combination of these.

Change-of-mind cancellations

Where you purchase an online course or workshop, you may have a 14-day cancellation period unless:

  • The course, workshop or digital content has already started with your consent.
  • You acknowledged that you would lose your cancellation right once access or supply began.
  • The course is for a specific date or limited scheduled period where the law provides an exception.
  • After access has started

Once you have accessed course materials, joined a live online workshop, downloaded materials, or started using the course content, we may not be able to offer a change-of-mind refund.

If there is a technical issue caused by our platform, link or files, please contact us and we will try to resolve the issue. Where we cannot resolve it within a reasonable time, we will offer an appropriate remedy.

Missed sessions

If you miss a live online session, we are not required to provide a refund unless stated otherwise at the time of booking. Where recordings or catch-up materials are available, we may provide access at our discretion.

7. In-Person Courses and Workshops

In-person courses and workshops are usually limited-capacity events, often involving venue hire, preparation, materials and tutor time.

Unless otherwise stated on the course booking page:

  • Cancellations made more than [X days] before the course date may receive a full or partial refund.
  • Cancellations made within [X days] of the course date may be non-refundable.
  • You may request to transfer your place to another person, subject to our approval.
  • If we cancel the workshop, you will be offered a refund or transfer to another available date.
  • If we reschedule the workshop and you cannot attend the new date, you may request a refund.

If the workshop includes physical materials already posted or supplied to you, the cost of those materials may be deducted from any refund unless the cancellation is due to our fault.

8. Gift Vouchers, Discounts and Promotional Purchases

Gift vouchers, discount codes and promotional offers may have their own terms, expiry dates or restrictions. Refunds for discounted purchases will normally be based on the amount actually paid.

Where a refund is approved for an order paid partly or fully by gift voucher, the voucher portion may be refunded back as voucher credit.

9. How Refunds Are Paid

Approved refunds will usually be made to the original payment method used at checkout.

Once approved, refunds are normally processed within 14 days, though your bank, card provider or payment processor may take longer to show the refund in your account.

We do not refund any additional costs caused by you choosing a delivery method more expensive than our standard delivery option, unless required by law.

10. Delivery Issues for Physical Products

Please ensure your delivery address is correct at checkout.

If an item is returned to us because the address was incorrect or delivery was not collected, we may ask you to pay the cost of reposting the item.

If your order appears lost or delayed, contact us and we will investigate with the postal or courier provider.

11. Your Statutory Rights

Nothing in this policy affects your statutory rights under Irish consumer law.

Your rights may differ depending on whether you bought physical goods, digital content, a service, a ticketed event, or a course/workshop. The Consumer Rights Act 2022 provides separate rules and remedies for goods, digital content and services.
